I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.
Is there are any problems using AP for India visit.
Any suggestion is appreciated

Hello All,
I have my EAD from Employer A. I have accepted fulltime offer from Employer B. I do not wish to file AC21 but would like to send G28 form to USCIS to change the representation so that I could recieve any queries from USCIS. My question is -
1. Would it be advisable to pick a attorney and ask him to file G28 so he could get any communications from USCIS.
OR
2. Would it be ok if I file G28 so I could get any communications from USCIS. Later, in case When I need to respond may be I could hire an attorney to respond to the query.
3. Also does not making address change in AR 11 automatically make the address change on all my cases like 485,EAD,AP etc? I am asking this because only AP and EAD are sent to me with address change but last query on 485 went to my attorney's address.
Also appreciate any of your advice to handle my case effectively after changing my employer.

My PD is still another 10 months away but my AP which was approved 2 months back is getting a Soft LUD everyday since the last 4 days. Does it signify anything?

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.
Your H1 is NOT subject to cap as you had H1 in last 6 years.

Here is my situation:
I94 expired on 2/12 and my H1b extension was filed on 2/24.
Both my EAD and AP are expired (getting them renewed now).
My 485 is pending status (PD is May 17th 2006).
My lawyer says he requested USCIS to use discretion to grant H1B extension (with extension of stay) even though its filed late. If USCIS does not agree, I need to leave the country to get visa stamped (for H1b) in which case my pending 485 application can get affected.
For that reason he doesnt recommend going that route if USCIS doesn't approve my H1B with extension of stay. He recommends to use my EAD to continue my work. My EAD is expired as well. Can I continue to work in this case (EAD pending renewal and H1b approved without extention of stay)?

Anandhi,
I would apply for the renewal EAD now. Are you using the EAD to work ? Normally if the EAD is not approved after 90 day wait, then one can get a temp EAD form the local office. Give yourself some time, just in case something gets dealyed.

Only exception are people with "extrodinary ability" (the David Beckham's and Michael J Fox's) and people who fall under "National Interest Waiver" category (EB1 only - people who hold a Ph.D.).

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...
