You should bring evidence of your strong ties to the country where you live now - evidence of a job, family, house, club memberships, bank accounts, etc. Anything you can think of that would show an immigration officer that you really intend to return home at the end of this trip.

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

My 485/EAD checks got encashed today. My questions is do I need I-140 before FP or EAD card.

I had filed my i-485 along wid my whole famliy on 2nd july . My checks got cashed yesterday for all of us. But when i seee online its shows case pending for all of us expect my younger son ..w ehave reciept but we cant locate his reciept number online.Its showing number doesnot exist . So wat can be the reason behind it. I have reciept numbers for his i-485 and i765 juss can see his status online..

hi attorneys,
i am currently on H-1B with employer A. i hv a job offer from employer B which is a mgr role based outside USA.
i know that if i work for 1+ yr with employer B outside USA then i can come back to USA on L1-A visa.
my question is - during this 1 yr period, can i work for employer B in USA on H-1B?

Here is my situation wrt to I 140 and EAD.
1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.

My PD is 02/2004 EB2-India, and I will be current in June. However, as noted by multiple folks, there is a chance that EB2-India might retrogress during the rest of the fiscal year.
Have folks had luck with an InfoPass interview so push your case? I am afraid that without any encouragement my case will just languish on somebodys desk or in a box.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?
Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

The Senate has far fewer groups, and they don't register at all.
But some caucuses have come to play prominent roles on the front lines of Capitol Hill. The Republican Study Committee has worked to amplify the views of the more conservative wing of the GOP. Marco Rubio has a challenge. He needs to appeal to conservatives in order to drum up enough votes to defeat popular Governor Charlie Crist in next year's Florida GOP primary. Then he has to run back to the middle to appeal to an increasingly liberal Florida general electorate. When it comes to immigration, he needs to come off as tough on illegally present workers. And then he somehow has to seem reasonable on the issue by the time he gets to the November election. The Miami Herald reports on how this is going to be a tough task.
