I blogged about Affidavits of Support here (http://martinvisalaw.blogspot.com/2009/03/faqs-on-affidavit-of-support.html) last year, and that blog post has received far more comments so far than any other post. I cannot answer specific questions via the blog , so I hope that last year's FAQs are a help. I recently found another great FAQ publication here (http://www.nilc.org/ce/nilc/sponsoredimms&bens-na-2009-08.pdf), from the National Immigration Law Center (NILC). The NILC article links to other useful resources from the government and from NILC itself. I hope you find this as informative as I did.

I have one question: My I-485 applcation (employment based) was rejected due to I-130 attachment in error.
If USCIS reject my entire package of I-485 because I have attached I-130 application. What are my options? Is there any law that USCIS can only reject I-130 and accept I-485 appplications (myself and for my wife)? I have seperate fee checks for all the applications.
Please help me....

Hi,
My parents are currently in the U.S. on their visitor Visa (B2) which has 10 yr validity running till 2014. Their visa was originally sponsored by my sister and brother in law. Now we would like to extend my parents current stay beyond the six months I94 and we want to file for an extension. However, the financial position of my sister has changed as she is out of a job now. Is it possible that we can show me (son) as a sponsor, showing my financial statements/pay stubs as proof of financial support? This might mean I am taking over sponsorship now though their 10 year visa was sponsored by my sister. Would this be a problem leading to rejection of extension, or worse, affecting the validity 10 year visa itself?
Please let me know. Appreciate your time. Thank you.

I just realized a stupid mistake was made after filing my COS from F1 to H1B. My employer sent the entire application this Monday to Vermont Premium Processing Center. I had no idea that the I-539 was not even needed and that I-129 and I-907 were sufficient enough to proceed with the COS. Anyway, is there a way to correct this error? I'm just hoping USCIS won't reject my application and just process my COS.
I included a separate check worth $300 to pay for the I-539 but the rest of the payments were issued by my sponsoring employer. I really thought I-539 was one of the requirements so I went ahead and included it.
Any input will be appreciated.
Thanks

I work for one of the biggest software companies which deals with PERM cases a lot. However, my case got audit notice and I'm really confused now.
My PD is Jan-19-2009 and I received my audit notice in 11/2009, and we replied in 12/2009. I just learnt today that it might be very likely to take more than 2 years to clear such a case and there is possibility to be denied.
I'm very worried that I might lose my PD, is it really true that my case won't be cleared for at least another year?

We need to make a very important decision this weekend and any help will be highly appreciated.
My husbands (EB3/India) employer is willing to give us a Labor Substitution/I-140 (PD: March 2005). But, I really want to apply for COS H4 to F1.
So the two options we have is
1) Apply for both Labor Substitution/I-140 and COS H4-F1
2) Apply for COS H4-F1 and let go of LC Sub.
I have spoken to a lawyer and he is saying that we can apply for both LC Sub and COS and that there is a very good chance that COS will also go through, although there is a very small risk. But, I am getting conflicting messages from other sources suggesting there is a high risk of COS being denied.
We are trying to determine the amount of risk we are taking if we apply for "LC Sub" and COS at the same time. If the risk is high, that we would just apply for COS H4-F1.
This is a really tough decision and any advice would be greatly appreciated.

Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

This was inevitable. As Chris Hayes of The Nation told Keith Olbermann this evening, a boycott could "recalculate the incentives" for the citizens of Arizona and the politicians in the state. Once Super Bowls and major conventions start to go elsewhere (as was the case two decades ago when a similar boycott was successfully used to protest the state's failure to recognize the Martin Luther King holiday), the cavalier anti-immigrant positions will become a lot more expensive. Hopefully, the business community and sensible Arizonans who are appalled by what just happened in their state will mobilize to repeal the bill...

Hi All,
I have come across situation where people who primarily filed 485 to NSC and their cases have been transferred to Texas or other places. In their notices the receipt date has been mentioned as the date on which the case received later by another service(TSC, CSC etc) center and not the date on which the case was first received by NSC.
So technically it is not the fault of the applcant and in some cases they lose 3 or more months for AC21.
Can someone or moderators explain if one can argue with USCIS to put the receipt date as the original for AC21 considerations.
Thanks & Regards

While filling my biographical information form (I-325a) I forgot to add one of my residential address which was in a different city where I stayed only for 2 months. I was wondering will that be a major issue?
I remember this is the address I gave when I got a job and they did a background check on me. If there are any repercussions how do I rectify the solution, can some one please respond?

The anti-immigration groups seem to be busy with strategic plans to challenge CIR. Hope IV is ready to make a strong case too.
