HI,
My 6 yr H1B is expiring within 4 months, my company will be filing for the 7th yr extension. Will there be any problem if I send my inlaws for visitor visa now.
Can any one please advice.

More H-1Bs and More high skilled foreigners will not only revive the economy, they will create more jobs for the currently unemployed Americans.
Let those who spread the false rumors that high-skilled foreigners "will work for less" that their lies are only hurting their own children and grand children. Whereas more high-skilled immigrants will ensure those children and grandchildren of nativists and of all Americans can also have an American dream, just like their parents did. My Wife is on H4/AOS.
Her H4 is going to expire in September and she is planning to travel soon.
She has AP and EAD but never used. I am on H1 and used AC21.
My questions are..
1) Can she go to home country and get her H4 stamped and return on H4?
2) Apply AP and return on AP?
3) Assume...If she returns on AP...and show valid EAD while entering at POE....
But by that time her H4 expires.... In this scenario...do we still need to apply H4 extension after entering US?
4) Who supposed to apply H4? Is it employer or H1 holder can also apply H4?

Hi,
My PERM application was denied recently and I am on my 7th yr extension which will be expiring FEB 2010. Reason for denial was the photocopy of the newspaper AD that DOL received is missing some words in the Newspaper name portion. My lawyer will be filing for an appeal.... My question is, should I be worried regarding having my H1B being extended?

Hi all,
Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....
I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...
So my questions are:
a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
c) Should I file for H1B Amendment also

Yes you can travel with H4 to US with your Wifes H1 and then transfer to H1 if its still vaild at the time of transfer.. Note you can also use your existing H1 as well, As per rule an H1 can be in the US for 6 years. if you have spent some time in between outside US that duration will not be counted in the 6 yrs. So calucate your exact number of days spent in US and if it exceds 6yrs then its not possible to use your existing H1. Note: the days spent on H4 will not be counted in 6 yrs but days spent on L1 will be counted.---

I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.
Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.
But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?
My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

One of my friends has been unemployed for the last 6 months but his AP and EAD are current. He needs to go to India in June. Will he face any problems while coming back into the country? Should he postpone his India trip till he he has been on a job for 3-4 months? If he starts his own company and gets a salary from that will it cause problems? Also Newark is his closest airport. Is Newark OK for AP or should he try Philadelphia or JFK in New York?

Hi,
My H1 was filed as an individual application while i was in India last year by a consulting company.Later in May 2007 i was transfered to US on L1B.
Since then i'm in US and now i have taken a vacation off, and during this i wish to appear for H1 stamping interview.
Supposedly i get my H1 visa stamped, i am hoping i will be able to travel to US but that will be on H1 with a new Employer, but i should be resigning with the old company once i reach there. (Please correct if this legal because my old company still thinks i am on L1)
And other hand if i'm not able to make it through stamping, my old L1 status is still valid ?
Please clarify the above doubts ...!!

Would it be ok for me to travel abroad next week, or are there some travel restrictions after we file the forms?
Do we need an official receipt from USCIS before I can leave the US, or before I came back from the US, or any other restrictions?
