Hi All,
Today I received an email from CRIS saying that they have sent me an RFE on my AP application. My wife's AP was approved last week, so it really confuses me about what this could be about? Can anyone shed more light on "probable" causes of I-131 RFE?
I have another question - my passport is expiring in November 2007. Could that be the cause of the AP RFE? I could get that renewed from Indian embassy in 10 days, so its not a problem. But, has anyone heard about cases where expiring passport causes RFEs?

Hello,
My original I-140 in the EB3 skilled category was denied by the TSC & is pending @ AAO because the attorney's cover letter asked for the application to considered in the professional category, instead of the skilled category.
I have been told that while that I-140 is pending at AAO I can file a new I-140 under the "Other" category &they will adjudicate that case on the same Lobor Certification. Is that accurate for the TSC?
We will also file another EB3 Skilled category I-140 which obviously will be kept in abeyance till the AAO rules on my original application.
Can an attorney please advise if I can have 2 I -140's on the same Labor Certification for different categories?

I have filed two I485 application for the same company. One I485 got approved(also received the Green card) in Oct and another got denied today.

Hello,
1. I last entered US in Dec 2009 on H1B valid till Sep 2012.
2. Was laid off, changed my status to F1.
3. Got new employer, transferred my H1B to the new employer, got approval notice with no I 94 attached. My H1B visa stamping is valid till Sep 2012.
What are my options? Do I need new H1B visa stamping? Or just re enter with new I94?

Hi I'm a US citizen and have around 15k or less credit card debt. All government loans were paid off. Something happened three and a half years ago in my home town and I had to leave Washington state and took care of it. So my question is: it's has been 3 and a half year and I'm heading back to washington state for short visit.
1. I'm sure the debt did gall into collection agency. Will it go to court?
2. Since I had been gone since 2007 and will there be a warrant on me since I didn't appear to court (if there was one)
3. I will be entering Vancouver bc airport then to Seattle by driving. I'm afraid I will get caught for warrant at the border.
Hopefully someone can answer my questions and thanks for the help in advance.

Could one of the lawyers/expert please provide their opinion on my situation?
In 2004, my H1B extension was denied and later on approved in Nunc Pro Tunc. The nunc pro tunc process took a total of 64 days and when approved my I-94 was NOT back dated. Hence, I do not have I-94 for 64 days. Later on in July 2007, I filed for my I485.
Since my approval, I have not traveled outside the country and I am currently on EAD based on my pending 485.
The question I have, it's bothering me a lot, Will the gap in I94 for 64 days cause any problems in my I485 approval?
Please advise.

A RFE is not related to the type of processing (regular / PP) but depends on how well the petition was prepared.

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.
