Hi,
Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

If i get you right, what you are asking is H1 to F1 conversion, why it is not possible ?
It is possible provided if one is maintaining his or her H1 status, till requesting to convert to F1.

I suggest that we all get together to discuss how we can help the effort that immigration voice has undertaken. I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.

If the MD state chapter is already having meetings, please ignore this message; but some one please send me the information on when these meetings take place.

Visitor's visa for my parents expired recently (it was a 5 yr VISA & they visited here 3 times and returned within 6 months each time) and they want to re-apply for a visa. My question is - Do I still need to send in the Document of Support, Employer and Bank letter or they can re-apply without these documents? On the safer side, I am sending the documents but in my view there should not be a need for the support documents...Anyone in similar boat?

Hi,
I wanted to now how you guys are going about AP and I94 renewals.
If we use AP to come to US, then our I-94 is valid only for 1 year i.e till AP expires.. So, if we apply for AP renewal, what will happen to I-94? Do we need to renew it? If yes, what is the procedure?
And, If we have a valid H4 visa for 2 more years but started working on EAD, when we enter into US, do we need to use AP for sure or can use H4 as it is still valid? If we use H4, will our EAD become invalid?
Please let me know.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

Hi,
my F-1 Visa expired about a month ago, and I am in my grace period while waiting for my OPT to come through. Yesterday I got the notification that I won the diversity lottery..
My question is as follows:
If I file to change status in the USA, but for some reason I do not get my OPT and get deported, do I lose my chances with the green card? or am I never out of status since I have a pending application? Please help!

Yes. Your dependents can go for a H4 visa stamping provided you (primary h1 beneficiary) were always in status. (which from your post looks like you were)
You will have to send your paystubs, latest h1 approval notice etc - with your family for the
h4 visa interview.

If you have only one copy ICE officer will make a copy at the port of entry and give you the original. If you have two copies, ICE will take one and give you the other.
