I think this is a valid question that is being asked and should be answered by IV core. Am always intrigued by our behind the scenes effort and the heck that is going on. I do not want to cross the line and judge the integrity on IV core, but would really like to know exactly what we are up to. At least we need to periodic conf calls and announcement of our efforts (and I understand there needs to be some secrecy with anti-immig watching us closely).

The bill being discussed in the senate if passed is going to be very detrimental to people that are stuck in the labor backlog centers. They wil be forced to redo their labor with the new point based system. That is not fair at all.

I got quite a few positive responses. On other side I got few negative messages, few pessimitics and few red dots on posts after I started this exercise. Sometimes it still bothers me but I guess I need to get out of this critics and appreciations and want to concentrate 100% on agenda: Fight against injustice in AC21 implementation.

First in First out is always the best option. Unfortunately that is not happening. In this scenario you should be happy that lot of people are getting green cards as the number of people in the line before you gets reduced and the visa numbers are not wasted. As some body said "Life is not fair".
The sad part is that some applicants who missed the boat called BEC with PD of around June 2004 on EB3/India got approved in June end/July time frame. I did see this on some forums external to IV.
I think there may be candidates from 2001/2002/2003 who may have applied in June/July 07. But if the rumors of NSC processing RD wise (as seen on some forum posts outside IV), then it is unfair to these people, because there may be others who missed the BEC boat and are ahead of these folks coming out of BEC.

I, for one, am happy with this Oct visa bulletin. This is how it should be. First give GCs to all those with < 2003 PD. You guys with 2006 and 2007 pd should be glad you even got to file I-485 and EAD. What are you bitching about?.

There are many folks who have their GC process going on since 2001, 2002 etc. This BEC thing was a bane for many people and many of them squeezed past it and got approvals (2004 EB3 etc).
So nothing is fair in the immigration process. Suck the frustration and start involving yourself in IV activities. Start by becoming a contributing member (and updating your signature with it). If you do not have the courage to do it, then do not start new threads.

SO,can we all try to get the unused visas recaptured.If they can do that for nurses and physical therapists ,they can do that to decrease retrogression.I dont think they require senate approval.

Do you usually get paid first and then work? Do you get the returns first then you invest? Do you get the overpaid tax back first and then you file the tax return?

I have not seen one single person getting so many red dots for playing a devils advocate and trying to defend USCIS. :D
All of us are passionate and sometimes this passion overtakes logic. If you are fed up with USCIS, suing them or putting pressure on them through Congress/Legislature/Press are the only options.
Courts and judges are definitely going to punish USCIS for any quantifiable losses suffered by us. If you can find any, sue them.
Actually those are not the only options. Another option is to leave the country. That's an option which has been taken by many people to head back to where they came from or to other countries where their skills are welcome. One needs to only read through some of the old threads of frustrated people moving to India, China, Canada etc.

I think a line or two on how the EB immigrant is hampered while waitng for those 5-10 years will be useful. (i.e limited by not being able to switch jobs or even roles within the same company because switching would mean restarting the GC all over from scratch, and spouses having to remain idle even if they are highly qualified on their own, and difficulty of investing in real-estate without any permanance)

Ah, so you are looking to purchase in Hyd. Here is the latest, if you already don't know.
There is a talk about HMDA which is an agency to overlook a project extending the Hyderabad to Bhongir in the East and to Medak in the west.
There will be strict implementation of plans for constructing new houses.
Realtors have already started marketing this and extracting high prices.
If you do have time to research, you can purchase land for cheap (around 3-4 thousand rupees per sql yard) in the outskirts.

Hey,
Looks like my employer will fill up the 7001 form but how about the main letter. Does that needs to be signed and addressed by employer as well ?
Because the Link for 7001 doesn't talk about sending a separate cover letter.

Your employer does not need to sign the letter. You can sign the letter. On section 12 of the form 7001 mention " please see the attached letter" and then include the letter to be mailed to Ombudsman's office.

My point - I am going to take things in a stride, basically wait till I can - doesn't hurt me as long as I go about my daily routine.
All who are thinking of jumping the fence and giving up, one piece of advice - if you do not have kids and plan to have any in this life, please do it NOW - have them be born here (all of them) and then move on with whatever / wherever you want to go.
At least this is a gift you will be giving your kids for their lifetime and all the generations following them (remember - a US citizen's kid can be a US citizen no matter where he/she is born) - so you will be arranging US citizenship for all your great^n * grand * kids (0 <= n <= infinity) !
This is how I think about it when I do not think about MYSELF. Once the kids are born, you can flaunt their American Passports and feel happy in their well-being and security (for whatever it is worth) and move on to Canada / India / Singapore / wherever! Live happily.
And do not forget your kids can sponsor you when they are 21.
