I may be wrong but this is just an omission in the language of the bill. The effective date was stated as the date the bill is introduced, I guess it will change to some thin like when it is signed in to law or sixty days or 180 days from that date. As I said I could be wrong, but it seemed unfair and not right to make it effective retroactively.

if the orignial post on this thread is really true, then eb2/eb3 india/china with p.d. older newer than 2002 should basically pack whatever they have so far and leave... is that a fair reading? does anyone care to ammend my statement to perhaps "newer than 2003 [or 2005]"?

In the past, we have sent emails and webfaxes to senators only to get canned- pre typed responses. Recently, I have realised that senators favour written letters, posted (with postage stamp) especially if it comes from constituents from their state. Same with house reps. I have talked to my senator's staff and they have advised me to write a letter. The staff member said, letters are always read, and responded.
Senator will send an inquiry to the appropriate agency. This will create an impact, if all of us write letters. I have written a letter about USCIS Visa- flip flop to my senators.

I am not sure if the guy with PD 2001 will get the number first as against one with PD 2006 when everything is "C" in the example you presented.
Past data, experience from my acquaintances, official NSC statements as well the SOP clearly indicates the contrary.

Yes because while the GC is pending the EAD/AP is given as a right not based on the merits. So you get a free ride, even if down the road you are not eligible for a GC...

This forum is for immigration purpose ..yes ..but if someone wants to educate themselves on other related/non related topics that should be fine a long as they are not forcing anyone to answer their question or coming in the way of the purspose of the forum..
any day better than some of the non-informative,unhealthy topics that have been discussed here..
But again each to their own as I guess everybody has their style of thinking what's healthy and what's not.

Finally got approval e-mail today after 180 bloody torturing days.:mad: Just in time for my travel on Feb 2nd. Still don't know if I will receive it before that.
Just to let you guys know, those of you who have passed their 3 months processing time limit, do make an infopass appointment. I did the same,got LUD in 3 days and approval in a week. Good luck to everyone who is waiting.

my labor was MS + 2 years. Attorney did not file my I140 under EB2 because I have 23 months full time experience and 2 years GA experience.

At least I know 3 or 4 universities in around MI and OH. They have only online classes and on Sunday. It allows most of the students to take their classes that way. The rest 6 days they can work any where and make money and pay the university. One of the universities has 90% of the students from one of the small countries adjacent to India.

Is there any Legislation/or anything that can be worked on to make it a Law for getting Citizenship application eligibility after 5 years (or 6 years considering time to process fingerprint/medical/etc..) of I-485 application Provided, it is been Pending for years becoz of Visa-Unavailability from state.

To kick up some dust and buzz, amongst our American collegues, TV news reporters, talking heads, professors etc., I suggested that we must write about this injustice. Taking SS Tax and Medicare tax from non -immigrants is injustice. Americans will not tolerate injustice. What we are discussing here, whether we should do something about this collectively at IV, so that our GC processes will be speeded up, as a indirect consequence. This great country should understand more the injustice is being done to us, the highly skilled immigrants

- in employment (cannot take promotion, cannot easily change jobs without losing Priority Date),

You must understand employment visas, like H1B are non-immigrant visas. That alone should make Uncle Sam stop collecting SS Tax and Medicare. If any trial lawyer does a class action law suit or what we call a Public Interest Litigation, the US government should be in lot trouble. Because no one is questioning, they are passing on. I was also told by a SWA high official, that there is a provision, that you can opt out of deduction of SS Tax and Medicare, if you are on H1.
I want to focus on core IV goals. I will not post any further on this SS Tax issue. But, my last word is: dual intent is dangerous and applicants will be denied visa and entry into US. So, readers be careful. You have a non-immigrant visa.

WILL I QUALIFY FOR A VISA?
In order to qualify for most categories of U.S. non-immigrant visas, you must be able to demonstrate to a U.S. Consular Officer that you have a permanent residence outside the United States that you do not intend to abandon. You may satisfy this requirement by showing you have strong economic and social ties to your country of residence. "Ties" are factors that would require you to return to your country of residence, upon completion of your temporary visit to the United States.
